Greenpeace v. DTI: Courts may also have their say in nuclear development

In July 2006, The UK Department of Trade and Industry (DTI) published a report to conclude an energy review. That review was an examination of electrical power generation in Britain and it included public consultation. The report announced a government decision to support nuclear new build as part of the UK’s future electricity generating capacity. In February 2007, the England and Wales High Court found that the DTI consultation process was a flawed exercise. In the complex process of societal decision-making, the risk perceptions of stakeholders are often indirectly represented by such court cases – and with potentially far reaching outcomes.
